When “False or Misleading Information” Becomes an Issue

When Sam reached out, he was extremely worried about his visa application.

He had received a letter from Immigration New Zealand raising concerns about the information provided in his application. The wording was serious, and while Sam believed he had been open and honest throughout, he wasn’t entirely sure what had gone wrong, only that it could affect both his visa outcome and his future in New Zealand.

Like many people in this situation, Sam had not intended to provide incorrect information. Parts of the application had been prepared under time pressure because his visa was about to expire, and some details, such as dates, employment history, and character-related information, may not have been as clear or complete as they could have been.

Understandably, Sam felt uncertain about what this meant and what steps to take next. He had already contacted Immigration New Zealand and also other lawyers and advisers, but was left without clear guidance or reassurance.

After being referred to MC Legal, Sam booked a consultation. We began by carefully reviewing the letter from Immigration New Zealand and working through the concerns that had been raised. The focus was on identifying exactly where the issues had arisen, particularly whether it was due to missing context, misunderstanding, or how the information had been presented.

My focus in these situations is always to slow things down and respond carefully, rather than react quickly. Often, when clients are stressed, some of the information may initially be missed.

From there, I helped Sam prepare a clear and considered response, supported by relevant documentation.

This included:

  • Clarifying the information that had originally been provided

  • Addressing each concern directly, with appropriate context

  • Supplying additional supporting documents where needed

  • Presenting the information in a way that was clear and easy for the immigration officer to follow

The aim was not just to respond, but to assist the immigration officer to fully understand Sam’s situation and assess the application fairly, based on complete and accurate information.

In Sam’s case, the matter was resolved without further requests for information or the application being declined. His visa was approved, and his plans to remain in New Zealand were secure.

Just as importantly, Sam moved from feeling stressed, overwhelmed and uncertain to having clarity, structure, and support throughout the immigration process.

Concerns about “false or misleading information” can feel serious, and they should be approached carefully. However, they are not always as straightforward as they first appear. In many cases, taking the time to properly understand the issue and respond in a clear and measured way can make a meaningful difference.
